Case 1063/2016 – Won an Appeal to the Administrative Court of the Supreme Court of Cyprus v. the Ministry of Defense

The case concerns a Minor Conscientious Objector Applicant due to Religious Beliefs.

The applicant was prohibited to be represented by his lawyer during the hearing and examination of his application.

The Court found that there was violation of the Article 6(3) of the European Convention on Human Rights, violation of the Article 12(5c) of the Cyprus Constitution and violation of the Article 53(13) in connection of the article 43(3), (4) of the L.158(I)/1999.

The Court annulled the decision of the Ministry of Defense and upheld the Applicant.

Additionally, the Court has charged costs against the Republic of Cyprus for 1300 euro plus VAT.
